With this well-argued piece, @Phil Koopman clarified where the conventional discussions on “a remote assistant can never become a driver” have gone wrong.

In a different but equally duplicitous initiative, AV companies are lobbying at state and federal levels for laws allowing AV operation within its ODD while at the standards level asserting that the ODD is a design requirement, beyond the reach of regulators, and therefore establishing that regulators cannot modify the ODD. This leaves no way for state or local authorities to exercise authority over interactive operational limits such as excluding AVs from fire response, failed bridges, demonstrations, etc. This would insulate the AV companies from not only tort liability, but also from reasonable limits on their operations.
